These Terms of Use ("Terms") govern your access to and use of heyEliora ("the Service", "Eliora", "we", "us", "our"), a personal AI assistant delivered via the Telegram messaging platform. By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
By sending any message to the heyEliora Telegram bot or accessing any heyEliora web property, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
heyEliora is an AI-powered personal accountability assistant. She provides motivational check-ins, goal tracking, reminders, and general conversation via Telegram. The Service is provided on an "as is" and "as available" basis.
You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these requirements.
Your Telegram account serves as your identity on the Service. You are responsible for all activity that occurs under your Telegram account when interacting with Eliora. We do not create separate login credentials.
You agree not to use the Service to:
You are solely responsible for all content you send to the Service. Any information you share in messages — including but not limited to personal details, financial information, health data, passwords, or other sensitive data — is shared at your own risk. We do not ask for or require any sensitive personal information to provide the Service.
We accept no liability whatsoever for any loss, damage, or consequence arising from sensitive information you voluntarily share through the Service. You agree that any decision to share such information is entirely your own.
The Service uses third-party large language models (currently Claude by Anthropic) to generate responses. You acknowledge and agree that:
The Service offers a free tier and paid subscription plans ("Pro"). By subscribing to a paid plan, you agree to pay the applicable fees. All fees are non-refundable unless required by applicable law. We reserve the right to change pricing at any time with reasonable notice. Failure to pay may result in downgrade to the free tier or suspension of access.
Your use of the Service is also governed by our
Privacy Policy. You can view all data stored
about you at any time using the /mydata command, and delete
it using the /forget command.
The heyEliora source code is released under an open-source license as published in our GitHub repository. The heyEliora name, branding, logo, and any non-code creative assets remain the intellectual property of heyEliora and may not be used without prior written permission. Content you submit to the Service remains yours, but you grant us a limited license to process it for the purpose of providing the Service.
We reserve the right to suspend, restrict, or terminate your access to
the Service at any time, for any reason, without prior notice or
liability. Reasons may include but are not limited to: violation of
these Terms, abusive usage patterns, suspected fraud, or any conduct we
determine, in our sole discretion, to be harmful to the Service or other
users. You may stop using the Service at any time. You may delete all
your data by sending the /forget command.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, INFORMATION, OR RESULTS OBTAINED THROUGH THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HEYELIORA, ITS CREATOR, CONTRIBUTORS, AFFILIATES, OR ANY RELATED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY (INCLUDING NEGLIGENCE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR TEN US DOLLARS (US$10), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless heyEliora, its creator, contributors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content you submit to or through the Service.
The Service relies on third-party platforms and services, including but not limited to Telegram, Anthropic (Claude), Vercel, and Turso. We are not responsible for the availability, accuracy, or conduct of any third-party service. Your use of third-party services is governed by their respective terms and policies.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of laws principles. You agree that any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore, regardless of your location. By using the Service, you consent to this jurisdiction.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and heyEliora regarding the Service and supersede all prior agreements, representations, or understandings.
